What this policy covers
This policy explains how we collect, use, and protect personal data when we contact business decision-makers as part of our outbound marketing activities, and when you visit this website.
Where we act as a data processor on behalf of a client (for example, sending outreach from a client’s lookalike domain), the client is the data controller and their own privacy policy governs that processing. That scenario is not covered in detail in this policy.
Users of our subdomains, including unibox.abmstars.com and other client-facing platforms, may have additional cookies and processing governed by separate notices presented on those platforms.
When we are the data controller
We are the data controller for personal data we collect for our own marketing purposes – that is, when we contact business decision-makers to introduce ABM Stars’ own services.
Categories of personal data we process
- Work email address
- Work telephone number (direct dial and switchboard)
- Job title and seniority
- Employer name and trading name
- Employer registered and trading address
- Public professional history (current and prior roles, tenure)
- LinkedIn profile URL
- Publicly stated areas of professional responsibility
- Engagement signals from our outreach (whether emails were opened, replied to, or bounced)
- Information you submit voluntarily via our website forms, live chat, or in direct conversation with us
We do not seek out or process special category data. We do not process consumer or private contact details.
Sources of personal data
We obtain personal data from the following sources:
- Companies House – the UK statutory company register
- LinkedIn – public profile information, accessed via the Clay data enrichment platform
- Crunchbase – public business directory
- PitchBook – public business directory
- BuiltWith – public technology footprint information
- DNS records and other publicly accessible domain records
- Direct from individuals – if you reply to our outreach, complete a form on our site, contact us via live chat, give us your business card, or otherwise provide information directly
We use Clay as a data processor to enrich and aggregate information. Clay’s own GDPR notice and opt-out flow is available at clay.com.
Lawful basis
Our lawful basis for processing your personal data for outbound marketing is legitimate interests under Article 6(1)(f) UK GDPR.
We have documented our Legitimate Interests Assessment (LIA), which weighs our commercial interest in identifying suitable B2B customers against your privacy rights. The LIA concludes that our processing of professional business contact data of senior decision-makers, by a small number of relevant emails or messages, with an easy opt-out, does not override your rights and freedoms.
A copy of our LIA is available on request to privacy@abmstars.com.
How long we keep your data
- Active prospects: while you are engaged with our outreach or while we reasonably believe you may be interested in our services, and for 24 months after last engagement.
- Customers and former customers: for the duration of the commercial relationship and 7 years after the relationship ends, to comply with our tax, accounting, and contractual record-keeping obligations.
- Suppression list entries: indefinitely, in one-way cryptographic hash form where possible. We retain these solely to ensure we do not contact you again.
- Audit logs of data subject requests and opt-outs: 3 years.
After these periods, personal data is purged from our active systems.
Who we share your data with
We do not sell your personal data. We share it only with:
- Our data processors (listed below in “Processors and sub-processors”)
- Regulators, lawyers, or law enforcement where we are legally required to do so
We may compile and share anonymised, aggregated statistics about our use of data (e.g. response rates by sector) with prospective investors, partners or advisers. Aggregated data does not identify any individual.
Processors and sub-processors
We use the following processors to deliver our service. Each is bound by a data processing agreement with us.
- Clay – Contact data enrichment and aggregation. United States (operates under UK and EU standard contractual clauses and the UK extension to the EU-US Data Privacy Framework).
- Hetzner – Cloud hosting of our data warehouse and applications. European Union (Germany / Finland).
- Bubble – TargetFlow application hosting. United States (operates under standard contractual clauses).
- Pipedrive – Customer relationship management. European Union (Estonia) with US sub-processors under SCCs.
- Notion – Internal knowledge management and operations. United States (operates under standard contractual clauses).
- Google Workspace – Email, document collaboration, and calendar. European Union with US sub-processors under standard contractual clauses.
- Xero – Accounting and invoicing. United Kingdom.
- WordPress – Public website hosting and content management. United States / United Kingdom.
- Instantly – Outbound email delivery. United States (operates under standard contractual clauses).
- JustCall – Telemarketing dialler and call records. United States (operates under standard contractual clauses).
- LeadLab – LinkedIn outreach automation. United Kingdom.
Where data is processed outside the United Kingdom or European Economic Area, we rely on the UK International Data Transfer Agreement, the EU Standard Contractual Clauses with the UK Addendum, the UK extension to the EU-US Data Privacy Framework, or another transfer mechanism recognised by the UK Information Commissioner’s Office.
This list is current as at the date at the top of this policy. We update it when processors change.
Your rights
Under UK GDPR you have the right to:
- Access the personal data we hold about you
- Rectify any inaccurate or incomplete data
- Erase your data (“right to be forgotten”) in certain circumstances
- Restrict our processing in certain circumstances
- Object to our processing – including an absolute right to object to direct marketing
- Portability – receive your data in a structured, machine-readable format and have it transmitted to another controller
How to opt out of our marketing
The fastest way to stop our outreach is to email privacy@abmstars.com with the subject line “Opt out”. You can also reply to any of our outreach emails with the word “unsubscribe” or “opt out”. We aim to action opt-outs the same business day and always within 5 working days.
When you opt out we add your contact details to our suppression list, which every future outbound send is checked against. Where possible, the suppression record is stored as a one-way cryptographic hash – meaning we cannot read it back into your contact details and cannot use it for any other purpose. If you would prefer we delete the suppression record entirely – and accept that this means we cannot guarantee not to contact you in future from newly-sourced data – tell us and we will action it.
How to exercise any other right
Email privacy@abmstars.com describing what you would like us to do. We will respond within 30 calendar days of receiving your request. For complex or numerous requests we may extend by up to two further months, in which case we will notify you within the first 30 days with the reason.
We may need to ask you to confirm your identity before we proceed. We will only ask for the minimum necessary and never for documents like passports unless there is a specific reason to do so.
Right to complain
If you are unhappy with how we have handled your data, please tell us first – we would rather know. You also have the right to complain to the UK Information Commissioner’s Office:
- Website: ico.org.uk
- Phone: 0303 123 1113
- Post: Information Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF
Automated decision-making and profiling
We do not make automated decisions about you that have a legal or similarly significant effect.
We do not profile you in any way that produces effects on you in your private life. We do analyse engagement signals (opens, replies, bounces) to decide whether to continue contacting you within a campaign sequence, and to refine which prospects we contact in future. This analysis does not produce any legal or significant effect on you and does not involve special category data.
